Rig control issue with Linux Mint 9 (isadora) -- Ubuntu variant

I am in a bind and hope that someone here can help me;

1) launching the program ...

cqrlog # ./cqrlog
[WARNING] Out of OEM specific VK codes, changing to unassigned
[WARNING] Out of unassigned VK codes, assigning $FF
Starting CQRLOG ...
rig_open: error =
rig_open: error = 250

2) When I try to use the program to control the radio the following happens and it dumps

TApplication.HandleException Access violation
Stack trace:

Access violation
Press OK to ignore and risk data corruption
Press Cancel to kill the program

[OK] ]Cancel]

TRX Control
Device: /dev/ttyS0/
Rig ID model: 229
Poll rate: 500

serial: 4800 Data bits: 8 Stop bits: 2 Handshake: N Parity: NONE

Linux mint - release 9 (Isadora)
Kernel: 2.6.32-21-generic

Additional Information
- hamlib utils installed is: libhamlib-utils 1.2.10-3
- Hardware works fine with same radios (Elecraft K3 and Ten Tec Orion 1) using the exact same cabling, just booting into Windows (Win 7 32 bit) running a number of Windows ham software
- hence I am inclined to believe that it must be something in the OS
